1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of all products and services provided by Beeps Venture Technologies LLP ("Beeps Card," "we," "our," or "us"), including the website at beepscard.com, the user platform at user.beepscard.com, the Beeps NFC physical business card, and any related digital profile features (collectively, the "Service").

By creating an account, placing an order, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Services Description

Beeps Card offers the following products and services:

• Beeps NFC Physical Card: A premium PVC business card embedded with an NFC chip. A one-time hardware purchase priced at ₹1,699. The card is printed with your name, designation, and a custom QR code as specified at the time of order.
• Digital Profile Subscription: A cloud-hosted digital business profile accessible via NFC tap or QR scan, available in three subscription tiers — Basic (₹199/year), Pro (₹299/year), and Enterprise (₹5,000/year). The subscription must remain active for the NFC card to function.
• Platform Features: Depending on your subscription plan, you may access features including contact sharing, social media links, product/service listings, photo and video galleries, appointment booking, enquiry forms, analytics dashboards, UPI payment links, Instagram feed integration, and team card management.

We reserve the right to modify, expand, or discontinue any feature at any time with reasonable notice provided via email or in-platform notification.

3. Account & Eligibility

• You must be at least 18 years of age to create an account and use our Service.
• You must provide accurate, current, and complete information during registration and keep it up to date.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• Each account is for individual use. Sharing your login credentials with third parties is not permitted unless you are on the Enterprise plan and using our team management features.
• You must notify us immediately at mail@beepscard.com if you suspect any unauthorised access to your account.
• We may refuse registration or suspend accounts at our discretion if we believe the provided information is false, or if the account is used in violation of these Terms.

4. Subscription & Billing

4.1 Subscription Plans

The digital profile subscription is required for your Beeps Card to function. Plans renew annually. Pricing is as follows:

• Basic: ₹199 per year — 1 virtual profile, core contact and social features.
• Pro: ₹299 per year — all Basic features plus custom links, CSS/JS customisation, SEO tools, blog publishing, affiliate commissions, and more.
• Enterprise: ₹5,000 per year — all Pro features for up to 20 virtual profiles, with custom physical card design.

4.2 Billing

• Payments are processed in Indian Rupees (INR) through our authorised payment gateway.
• Subscriptions automatically renew at the end of each billing year unless cancelled before the renewal date.
• You will receive a renewal reminder email at least 7 days before your subscription expires.

4.3 No Free Trial

Beeps Card does not offer a free plan or trial period. The Basic plan at ₹199/year is the minimum entry point.

4.4 Refund Policy

• Subscription fees are non-refundable once the subscription period has commenced.
• NFC physical card purchases are non-refundable due to the customised nature of the product (printed with your specific details). If you receive a defective or damaged card, contact us within 7 days of delivery and we will arrange a replacement.
• In exceptional circumstances, refund requests may be reviewed on a case-by-case basis at our sole discretion. Email mail@beepscard.com with your order reference.

5. NFC Physical Card

• The NFC card is a physical product shipped to your address within India. Typical delivery time is 7 business days after order confirmation, subject to courier conditions.
• The card is manufactured from premium PVC material and is available in black or white finish.
• The NFC chip embedded in the card has no battery and is designed for lifetime use. Physical wear and tear, bending, or damage from improper handling is not covered under replacement.
• The card links to your active Beeps Card digital profile. If your subscription lapses, the NFC card will cease to redirect visitors to your profile until the subscription is renewed.
• Card specifications (name, designation, QR code) are fixed at the time of order. Changes to the physical print require a new card order at the full purchase price.
• Shipping is available across India. We are not liable for delivery delays caused by courier partners or events outside our control.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You must not:

• Publish content that is illegal, defamatory, obscene, fraudulent, threatening, or that violates any applicable law or regulation.
• Impersonate any person, company, or entity, or misrepresent your identity or affiliation.
• Use the Service to conduct phishing, spamming, or any form of unsolicited communications.
• Upload or share malware, viruses, or any harmful code via your profile or the platform.
• Attempt to gain unauthorised access to our systems, other user accounts, or related infrastructure.
• Use the Service in a way that disrupts, degrades, or impairs its availability or performance for other users.
• Resell or sublicense access to the Service without our express written permission.
• Use automated bots or scrapers to extract data from the platform.
• Violate any applicable Indian or international laws, including the Information Technology Act, 2000, and DPDPA 2023.

We reserve the right to remove any content and suspend or terminate your account if we determine, at our sole discretion, that you have violated these rules.

7. Intellectual Property

7.1 Our Content

The Beeps Card name, logo, website design, platform code, and all associated materials are the intellectual property of Beeps Venture Technologies LLP. You may not copy, reproduce, distribute, or create derivative works from our materials without our prior written consent.

7.2 Your Content

You retain all ownership rights to the content you upload to your Beeps Card profile (photos, videos, text, etc.). By uploading content, you grant us a non-exclusive, royalty-free licence to host, display, and deliver that content solely for the purpose of operating your profile and providing the Service.

You are solely responsible for ensuring that your content does not infringe on any third-party rights, including copyright, trademark, or privacy rights.

8. Limitation of Liability

To the fullest extent permitted by applicable Indian law:

• Beeps Card is provided on an "as is" and "as available" basis, without warranty of any kind, express or implied.
• We do not guarantee uninterrupted, error-free service availability at all times.
• In no event shall Beeps Venture Technologies LLP, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
• Our total cumulative liability for any claims arising from these Terms shall not exceed the amount you paid to us in the 3 months preceding the claim.

Nothing in these Terms excludes liability for fraud, gross negligence, or personal injury caused by our negligence, to the extent such exclusion is not permitted by law.

9. Termination

9.1 By You

You may cancel your subscription at any time from your account dashboard. Access to your digital profile will continue until the end of the paid subscription period. No refund is issued for the remaining subscription period.

9.2 By Us

We may suspend or terminate your account and access to the Service immediately, with or without notice, if:

• You violate any provision of these Terms.
• We are required to do so by law or a regulatory authority.
• Continued provision of the Service to you would expose us to legal liability.

Upon termination, your profile will be taken offline and your data will be handled as described in our Privacy Policy.

9.3 Survival

Sections relating to intellectual property, limitation of liability, governing law, and dispute resolution shall survive termination of these Terms.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-platform notice at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Ernakulam, Kerala, India.

In the event of any dispute, the parties shall first attempt to resolve the matter amicably by written notice. If not resolved within 30 days, the dispute shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.
